Employers continue to prepare for the forthcoming changes to the overtime rules, particularly the increases in the minimum salary required for exemption as an executive, administrative, or professional employee. The U.S. Department of Labor (DOL) has received more than 290,000 comments (available here) to its proposed rule. The final rule is expected sometime in 2016, and the DOL is not providing a more specific timetable at this time. A timetable for publication of the final rule will be included in the DOL’s Fall 2015 Semiannual Regulatory Agenda, which is likely to be published in the next couple of months. The regulatory agenda may only have an estimated timetable, however, and not a firm timetable. Once the final rule is published, employers are likely to have at least 60 days to come into compliance before the new rules become effective.
